The Preservatives Behind the Shampoo Lawsuits

If you've followed the wave of hair care lawsuits over the past few years, the same brand names keep surfacing: OGX, TRESemmé, and Suave. The claims read like a horror story: hair falling out in clumps and burning scalps with bald patches. Most coverage skips the part that matters for your next wash. These lawsuits aren't really about the shampoo, they're about a small group of preservatives and additives in the ingredient list, and what those ingredients can do to a scalp over time.

Here's what the peer-reviewed evidence actually shows about the ingredients driving these cases, why regulators in Europe have restricted several of them, and how to read a label with a clinician's eye.

What the Shampoo Lawsuits Are Actually About

The headline cases share one ingredient: DMDM hydantoin, a formaldehyde-releasing preservative. In the OGX litigation against Johnson & Johnson and Vogue International, plaintiffs alleged that DMDM hydantoin caused hair loss and scalp injury [1]. Those cases have largely stalled. The best-known OGX class action was dismissed with prejudice in 2022, and as of mid-2026 there is no large public settlement paying consumers [1].

The Unilever cases carry more history. Unilever recalled a Suave Professionals keratin smoothing product in 2012 after complaints of hair loss and scalp burns, then settled for roughly $10.2 million [2][3]. Plaintiffs in the newer TRESemmé litigation argue Unilever has known since at least 2012 that DMDM hydantoin can contribute to hair loss and scalp irritation, yet kept using it [3]. That consolidated class action was still active in federal court in Illinois as of 2025, with no class certification ruling and no trial date set [2].

One correction to the way this gets reported: no regulator pulled these products from shelves for hair loss. J&J voluntarily stopped producing OGX with DMDM hydantoin in 2021, though existing stock stayed on shelves [1]. The 2012 Suave action involved a voluntary recall of a single smoothing kit [3]. That distinction matters, because it means the burden of reading the label still sits with the shopper.

The Ingredients Worth Watching

Not every ingredient below carries equal risk, and we will not pretend otherwise. Here is where each one sits on the evidence.

DMDM Hydantoin

A formaldehyde donor. Each molecule releases trace formaldehyde over the product's shelf life to keep the formula free of bacteria, yeast, and mold [4]. Formaldehyde is classified as a known human carcinogen, but that classification comes from inhalation and occupational exposure, not shampoo. In hair care the documented harm is allergic contact dermatitis, not cancer [5]. A 2022 clinical review in Contact Dermatitis confirms that DMDM hydantoin and the other formaldehyde releasers readily provoke localized, airborne, and even scalp-pattern dermatitis in sensitized people [5]. Analytical work has shown these releasers can generate more than 200 ppm of free formaldehyde under the right formulation conditions, enough to trigger a reaction, and you cannot tell how much any given bottle releases from the label alone [6]. In the US, roughly 20% of personal care products contain a formaldehyde releaser, and contact allergy to them is meaningfully more common here than in Europe [7]. This is the ingredient at the center of every one of these lawsuits.

Quaternium-15, Imidazolidinyl Urea, and Diazolidinyl Urea

The other common formaldehyde releasers. If you are avoiding DMDM hydantoin for scalp sensitivity, these belong on the same list, because they share the same mechanism [5][6]. Quaternium-15 has historically been the most sensitizing of the group, and free formaldehyde and quaternium-15 are already banned in EU cosmetics [5].

Methylisothiazolinone (MI/MIT) and Methylchloroisothiazolinone (MCI/CMIT)

When MI was approved for stand-alone use in cosmetics in 2005, it triggered one of the most significant contact allergy epidemics dermatology has documented [8][9]. The American Contact Dermatitis Society named MI its Contact Allergen of the Year in 2013 [9]. The regulatory response followed: the EU banned MI and the MCI/MI mixture from leave-on cosmetics between 2016 and 2017 and capped them in rinse-off products like shampoo at 15 ppm [8]. Here the transatlantic split is stark. After the European restrictions, MI allergy declined in Europe but kept climbing in North America, where MCI/MI positivity rose from 2.5% in 2009 to 10.8% by 2018, and standalone MI reactivity reached 15% in one North American patch-test cohort [10]. There is no federal US ban [10]. MI can cause scalp dermatitis specifically, which is why it earns a place here [9].

Fragrance / Parfum

A single word on a label can legally stand in for dozens of undisclosed compounds. Fragrance is one of the most common causes of cosmetic contact allergy, and because the mixture is proprietary you often cannot identify what you are reacting to. For a reactive or itchy scalp, fragrance-free is the cleaner starting point.

Cocamidopropyl Betaine (CAPB)

The nuanced one. CAPB is a coconut-derived surfactant found in most shampoos, including sulfate-free formulas, and most people tolerate it well [11]. It was named Contact Allergen of the Year in 2004 after sensitization rates climbed to an estimated 3% to 7% [11][12]. The important detail: the CAPB molecule itself is largely not the allergen. The reactions trace to manufacturing impurities, amidoamine and dimethylaminopropylamine, left over from synthesis [13]. CAPB allergy characteristically shows up as eyelid, facial, scalp, and neck dermatitis [12]. Worth knowing if you have a persistent scalp reaction you cannot explain, and worth noting that switching to a "sulfate-free" bottle does not remove it. It does not sit in the same risk tier as the formaldehyde releasers.

Why Your Scalp, Specifically

Scalp skin is thin, densely vascular, and packed with follicles, which makes it more permeable than the skin on your forearm. A preservative that produces a mild reaction elsewhere can present on the scalp as itching, burning, flaking, redness, or shedding.

Chronic low-grade inflammation is not only a comfort problem. A growing body of histologic work shows that persistent perifollicular microinflammation is a real contributor to hair loss, not just a bystander. Scalp biopsy studies find perifollicular lymphocytic inflammation in the large majority of pattern hair loss specimens, and this low-grade immune activation is associated with follicular miniaturization and the transition from reversible thinning to follicle atrophy [14][15]. An inflamed, irritated scalp is a poor foundation for growth, which is the whole reason scalp health sits upstream of hair health.

This is also why causation is genuinely hard to prove in court, and worth being honest about. Hair loss has many drivers: genetics, hormones, thyroid function, postpartum shifts, medication, stress, and nutrition among them [1]. A shampoo can be one input without being the whole story. The strongest cases have a clean timeline: a product goes on, the scalp reacts within days, a clinician documents it, the product comes off, and things improve [1].

How to Read a Label Like a Clinician

You don’t need a chemistry degree to shop more carefully.

  • Scan the preservative system first. Formaldehyde releasers and isothiazolinones have the clearest link to scalp reactions. If your scalp is reactive, start there.

  • Treat "parfum" as an unknown. For a sensitive scalp, fragrance-free removes a whole category of guesswork.

  • Don’t fear every long word. Silicones like dimethicone, mild surfactants, and many plant-derived ingredients are not the problem here. Precision beats panic.

  • "Sulfate-free" is not "irritant-free." A sulfate-free bottle usually still relies on CAPB and can still carry MI or a formaldehyde releaser in its preservative system [11]. Read the whole list.

  • Watch how your scalp responds, not just your hair. Itching, tightness, or flaking after a wash is data. A trichoscopic assessment can show what is happening at the follicle before it becomes visible thinning.
